Maintaining E-3 Status
You must follow specific requirements to maintain your E-3 status while working in
the United States. Failing to follow these rules may affect your ability to remain
employed or stay in the U.S.
Work Authorization
Your E-3 status is employer-specific and position-specific.
You must:
- Work only for the employer listed on your E-3 petition or LCA
- Perform only the duties described in your position
- Work at the approved location(s) listed on the LCA
You cannot:
- Begin employment without proper E-3 authorization
- Work for a new employer without obtaining new E-3 authorization
Changes to Your Employment
You must contact Visa and Immigration Services (VIS) before any changes, including:
- Job title or duties
- Work location
- Salary or funding source
- Department or supervisor
Changes may require a new LCA and/or a new E-3 petition before they can take effect.
Maintaining Valid Documents
You must keep the following documents valid at all times:
- Your passport (valid for at least 6 months into the future)
- Your Form I-94 record, which confirms your E-3 status and authorized stay
- Your E-3 approval notice (if applicable)
You are responsible for monitoring your expiration dates.
Important Reminder
It is your responsibility to maintain your E-3 status at all times. Staying informed and reporting changes early will help you avoid interruptions to your employment or immigration status.
