Maintaining O-1 Status
You must follow specific requirements to maintain your O-1 status while working in
the United States. Failing to follow these rules may affect your ability to remain
employed or stay in the U.S.
Work Authorization
Your O-1 status is employer-specific.
You must:
- Work only for the employer listed on your approved O-1 petition
- Perform only the duties described in the petition
- Work at the approved work location(s)
You cannot:
- Begin employment until your O-1 petition is approved by USCIS
- Work for a new employer unless a new O-1 petition is filed and approved
Changes to Your Employment
You must notify Visa and Immigration Services (VIS) of any changes, including:
- Job title or duties
- Work location
- Salary or funding source
- Department or supervisor
Some changes may require an amended O-1 petition before the change can take effect.
Maintaining Valid Documents
You must keep the following documents valid at all times:
- Your passport (valid for at least 6 months into the future)
- Your Form I-797 (O-1 Approval Notice)
- Your I-94 record, which confirms your period of stay
You are responsible for monitoring your expiration dates.
Important Reminder
It is your responsibility to maintain your O-1 status at all times. Staying informed and reporting changes early will help you avoid interruptions to your employment or immigration status.
