Federal Court Vacates $100,000 H-1B Fee Requirement

A federal judge in Massachusetts has vacated the $100,000 H-1B fee requirement that was announced earlier this year.

Visa and Immigration Services (VIS) is currently reviewing the available information, consulting with immigration counsel, and monitoring ongoing litigation and agency guidance to determine whether there may be any impact on future H-1B filings.

At this time, VIS is not able to provide definitive guidance regarding the long-term implications of this decision. Departments and prospective H-1B employees should continue to follow existing H-1B sponsorship and immigration processing procedures unless otherwise advised by our office.
