Update: USCIS Clarifies Scope of H-1B Proclamation

We are writing to share updated information regarding the Presidential Proclamation (dated 9/19/25) restricting entry of certain nonimmigrant workers. Today (9/20/25), USCIS issued a memo clarifying that:
“The proclamation does not apply to aliens who: are the beneficiaries of petitions that were filed prior to the effective date of the proclamation, are the beneficiaries of currently approved petitions, or are in possession of validly issued H-1B nonimmigrant visas.”
According to this guidance, individuals who already hold an approved visa, have an approved H-1B petition, or have a properly filed and pending H-1B petition should not be affected in their ability to travel to the United States.
Because different agencies oversee different parts of the process, we recommend that H-1B holders currently outside the United States carry a copy of this USCIS memorandum when seeking reentry, in case Customs and Border Protection requests clarification.
