DHS Proposes Changes to Duration of Status (D/S)
August 28, 2025The Department of Homeland Security (DHS) has proposed a rule that would change how long F-1 and J-1 students are allowed to remain in the United States.
Under the proposal, the current “duration of status” (D/S) framework would be replaced
with a fixed period of stay and a specific program end date. Any future updates—such
as a program extension, school transfer, or change in academic level—could require
formal approval from U.S. Citizenship and Immigration Services (USCIS).
Current Status of the Rule
This is a proposed rule only and is not currently in effect.
The federal government opened a 30-day public comment period, which closed on September 29, 2025. DHS will review submitted comments before determining next steps. The proposal may be revised before any final rule is issued.
What This Means Right Now
- No immediate changes have been made to F-1 or J-1 regulations
- You should continue to follow current immigration requirements
- Your status remains valid as long as you maintain compliance under existing rules
