Military Critical Technical Data Agreement (DD Form 2345)
Overview
The Military Critical Technical Data Agreement (DD Form 2345) is used by eligible U.S. and Canadian organizations to apply for certification under the U.S./Canada Joint Certification Program (JCP).
JCP certification may provide eligible organizations with access to certain unclassified, export-controlled military critical technical data administered by the U.S. Department of Defense (DoD) or Canada's Department of National Defence (DND).
Stony Brook University does not currently maintain an active JCP certification.
If a solicitation, sponsor, collaborator, conference, meeting, or other activity requires JCP certification or a DD Form 2345, contact the Office of Research Security (ORS) before proceeding.
When Might a DD Form 2345 Be Required?
A DD Form 2345 or JCP certification requirement may arise in connection with:
- DoD or DND solicitations or sponsored research opportunities.
- Access to certain unclassified export-controlled military critical technical data.
- DoD or DND conferences, meetings, or other restricted events.
- Technical exchanges with defense contractors or subcontractors.
- Requests for export-controlled technical data from a government agency or defense contractor.
- Proposal or award representations requiring JCP certification.
A requirement for a DD Form 2345 does not necessarily mean that the proposed activity cannot proceed. ORS will review the requirement and determine appropriate next steps.
Joint Certification Program
The Joint Certification Program (JCP) is administered jointly by the U.S. Department of Defense and the Canadian Department of National Defence.
Organizations seeking JCP certification submit a DD Form 2345 and supporting documentation to the Joint Certification Office. Certification requirements and eligibility are established by the JCP.
JCP certification does not, by itself, authorize unrestricted access, use, release, or export of controlled technical data. Additional export control, safeguarding, contractual, cybersecurity, or other requirements may apply to the information or activity.
Joint Certification Program (JCP)
University Certification Status
Stony Brook University does not currently maintain an active certification under the Joint Certification Program.
Researchers should not independently submit a DD Form 2345 or register for JCP certification on behalf of the University.
If JCP certification is required for a proposed University activity, contact ORS. ORS will review the requirement and coordinate any necessary institutional process.
Working With JCP-Controlled Technical Data
Access to technical data obtained through the JCP may carry export control, access, safeguarding, dissemination, or other requirements.
Before receiving, accessing, storing, sharing, or using JCP-controlled technical data, ORS must evaluate the applicable requirements.
Depending on the activity, safeguards may include:
- Restrictions on access to authorized personnel.
- Physical or electronic access controls.
- Secure storage and transmission requirements.
- Restrictions on foreign-person access.
- Export control review.
- Technology Control Plans.
- Cybersecurity or sponsor-specific information protection requirements.
ORS will coordinate with researchers and appropriate University offices to identify applicable requirements.
What Should I Do?
Contact ORS if:
- A solicitation or sponsor requires JCP certification.
- You are asked to provide a DD Form 2345 or JCP certification number.
- You need access to military critical technical data through the JCP.
- A conference, meeting, or other event requires DD Form 2345 certification for participation.
- A defense contractor or government agency asks you to demonstrate JCP eligibility.
- You receive or are offered technical data identified as JCP-controlled or otherwise export controlled.
Do not submit a DD Form 2345 on behalf of the University or accept controlled technical data before the applicable University requirements have been reviewed.
